Privacy Policy

This Policy is to be read in conjunction with Terms and Conditions, all of which collectively govern the User's engagement with the Love Café Online Store.

Currymuch is committed to transparency and to clearly explaining how Users’ personal information is collected, used and protected while continually working to improve the User’s online experience. The data controller of the User’s personal information is Currymuch. By accessing, downloading, or using the Love Café Online Store, the User consents to be bound by the terms of this Privacy Policy. If the User does not agree with the contents of this Privacy Policy, the User shall stop using the Love Café Online Store immediately. The User may browse the Love Café Online Store without providing personal information, unless the User choose to create an account or place an order through the Love Café Online Store. This Privacy Policy is subject to change at our discretion and without prior notice. We strongly recommend that the User reviews the Privacy Policy periodically for updates.

1. Collection of Personal Information

Currymuch may collect personal information when: (i) personal information is provided by the User to Currymuch and (ii) information is collected by Currymuch via automated methods when the User uses the Love Café Online Store.

(i) personal information is provided by the User to Currymuch The User may provide the following information to Currymuch

a. personal details, such as name, postal and email addresses, phone number and date of birth at the time of registration on the Love Café Online Store
b. transaction information, including information about the products the User purchases, prices, method of payment and payment details;
c. account information, such as the User’s username or password (or anything else that identifies the User) used to access the Love Café Online Store or to buy or use the products and services of the Love Café Online Store;
d. profile information, including products and services the User likes, or times the User prefer to visit the Love Café Online Store; and
e. other personal information the User chooses to provide Currymuch when the User interacts with Currymuch (including through social media and call centers).

(ii) information is collected by Currymuch via automated methods when the User uses the Love Café Online Store. Currymuch may use automated technologies to collect information from the User’s computer system or mobile device when the User accesses the Love Café Online Store. The information that may be automatically collected by Currymuch includes, but is not limited to, the following:

a. Internet Protocol (IP) address;
b. Operating system and browser type used by the User's device;
c. Type and configuration of the User’s mobile device;
d. Unique device identifiers such as UDID (Unique Device Identifier) or MEID (Mobile Equipment Identifier);
e. Device and component serial numbers;
f. Advertising identifiers (e.g., IDFA on Apple devices or similar identifiers on other platforms);
g. Referring webpage or application (i.e., the source that directed the User to the Love Café Online Store);
h. Online activity and interactions with other websites, applications, or social media platforms;

i. Activity related to how the User navigates and interacts with the Love Café Online Store, including specific pages visited or functions used.

Currymuch may also collect information regarding the User’s device location using technologies such as GPS, Wi-Fi, Bluetooth, or cell tower proximity. This information may be used to provide location-based services or functionality through the Love Café Online Store.

Most devices and browsers provide the User with the ability to disable location tracking or adjust privacy settings to restrict certain types of data collection. The User is encouraged to consult their mobile device service provider, device manufacturer, or web browser provider for detailed instructions on how to disable location-based data collection at the device level.

The User acknowledges and accepts that certain features or services on the Love Café Online Store may not function properly without access to location data or other automated identifiers. Additionally, Currymuch collects personal information directly from the User when they:

a. Create or modify an account on the Love Café Online Store;
b. Participate in surveys, reviews, or opinion polls;
c. Communicate with Currymuch through any digital means or customer service channels.

2. Use of Personal Information

Currymuch shall use each category of personal information collected from the User for legitimate business purposes, strictly in accordance with applicable data protection laws. Such purposes include, but are not limited to, the following:

a. To fulfil contractual obligations arising from the User’s purchase of products or services through the Love Café Online Store, including processing payments, order confirmations, deliveries, and providing customer and technical support;
b. To manage and administer Currymuch’s ongoing relationship with the User, including handling User feedback, conducting service evaluations, and facilitating customer engagement surveys;
c. To enhance, personalise, and optimise Currymuch’s products, services, website, mobile application, and overall customer experience. This includes refining existing technologies and developing new services or features, including limited profiling, provided such profiling does not result in automated decisions that produce legal or similarly significant effects on the User, unless otherwise notified or consented to;
d. To send general and personalised direct marketing communications, whether electronic or non-electronic, relating to Currymuch’s own products, services, offers, and promotions, or those of its affiliated partners, including promotional events, competitions, and loyalty programmes. The User may opt out of such communications at any time;
e. To conduct internal business analytics, statistical modelling, market research, and consumer trend forecasting to evaluate sales effectiveness, service performance, marketing impact, and projected customer demand;
f. To maintain the security and integrity of Currymuch’s online platforms, infrastructure, and digital assets, including monitoring, detecting, preventing, and investigating any suspected or actual security breaches, system misuse, or unauthorised access;
g. To detect, prevent, and mitigate fraud, criminal activity, and other unlawful conduct, and to manage claims, disputes, or other liabilities;
h. To protect the health, safety, rights, property, and legitimate interests of Users, staff, contractors, service providers, and the general public;
i. To anonymise or pseudonymise personal information for further internal or lawful external use, provided such data no longer directly or indirectly identifies the User;
j. To comply with statutory, regulatory, or legal obligations, including law enforcement requests, court orders, or compliance with internal corporate governance policies or codes of conduct;
k. To establish, exercise, or defend legal claims in any relevant jurisdiction or legal forum, whether in litigation, arbitration, or regulatory proceedings.

Currymuch may process the User’s information for additional purposes where such purposes are compatible with the original purpose of collection, or where legally required. In such cases, Currymuch shall provide notice to the User prior to using their data for such alternate purposes.

3. Lawful basis for Collecting, Processing and Storing Personal Information

The legal basis for processing personal information shall be one or more of the following:

a. The User has provided consent at the point of registration for Currymuch to do so, by accepting the Terms of the Love Café Online Store;
a. Processing the User’s data in the way explained above is necessary for Currymuch to provide services;
a. Processing is necessary for compliance with a legal obligation Currymuch may have;
a. Processing is necessary for the purposes of pursuing legitimate interests of Currymuch.

Currymuch requires personal information and consent to use the User’s personal information in order to deliver services and without this Currymuch will not be able to provide services to the User. However, Currymuch shall not access any other personal information except the information required/derived through the Love Café Online Store.

4. Sharing Personal Information

Currymuch will not share personal information of the User with any third party unless Currymuch has obtained permission from the User or under the following circumstances where it is lawful to do so:

a. when there is a necessity to provide the User with further products or services;
b. when Currymuch has a legitimate business reason for doing so;
c. in the event Currymuch is involved in a merger, acquisition, restructuring, bankruptcy, or sale of all or some of its assets;
d. when Currymuch has a legal obligation to do so or if it believe that it is reasonably necessary to comply with a law, regulation, legal process to protect the safety of any person; address fraud, security, or technical issues; or protect Currymuch’s rights or the rights of those who use Currymuch’s services by assisting with detecting and preventing fraud, regulatory reporting, litigation or asserting or defending legal rights and interests.

5. Access to Management of the User’s Personal Information

The User may access and change the User’s personal information including personal data, purchase history by logging to the Love Café Online Store. There, the User can view the details of the User’s orders that have been completed, those which are open and those which are shortly to be dispatched. The User shall undertake to treat the personal access data confidentially and not make it available to unauthorized third parties. Currymuch will not assume any liability for misuse of passwords unless this misuse is caused due to internal fault of Currymuch.

6. Cookies

Cookies are used to enhance User experience, including for analytics, personalisation, performance monitoring, and remembering preferences. The acceptance of cookies is not a requirement for visiting the Love Café Online Store.

Cookies can be used to recognize the User’s Internet Protocol address, saving the User time while the User is on, or want to enter, the Love Café Online Store. Currymuch shall only use cookies for convenience of the User in using the Love Café Online Store. The browser of the User can be set to not accept cookies, but this would restrict the use of the Love Café Online Store.

7. Third Party Tools

Currymuch may use third-party analytics tools to better understand User interactions and improve services. Data may be collected, processed, and stored in accordance with the respective third-party privacy policies

8. Security measures

Currymuch shall take all reasonable steps to ensure appropriate physical, technical, and managerial safeguards are in place to protect the User’s personal information from unauthorized access, alteration, transmission, and deletion. Currymuch shall ensure that third-parties who provide services to Currymuch under appropriate agreements take appropriate security measures to protect personal information of the User in line with Currymuch policies.

9. Period of Storage

Currymuch will retain and store personal information of the User as long as the User uses the Love Café Online Store. When Currymuch has no ongoing legitimate need to process the User’s personal information, Currymuch will delete User’s information within one (1) month of the User uninstalling the Application and terminating services on the Love Café Online Store unless a longer retention period is required or permitted by law.

10. Changes to this Privacy Policy

Currymuch keeps its Privacy Policy under regular review, and will update the same without any notification to the User. It is the responsibility of the User to periodically review the Privacy Policy of Currymuch to stay informed of such changes. Any information Currymuch collects is subject to the Privacy Policy in effect at the time it is collected. By continuing to access or use the Application and services provided via the Love Café Online Store after any changes come into effect, the User is agreeing to the revised Privacy Policy.

11. Personal Information Rights

The User may have certain rights (subject to the conditions and extent specified in the law):

a. Right to access: The User may have the right to check whether Currymuch holds any personal information about the User and request access to or copies of such data.
b. Right to correction or deletion: The User may have the right to request the correction or deletion of inaccurate, incomplete, outdated, unnecessary, excessive, or other applicable personal information about the User.
c. Right to restriction: The User may have the right to request the restriction of the collection, processing, or use of the User’s personal information.
d. Right to object and withdraw consent: In specific situations, the User may have the right to object to the processing of the User’s personal information for legitimate reasons or withdraw previously granted consent without affecting the lawfulness of processing prior to the withdrawal.
e. Right to data portability: The User may have the right to request the User’s personal information in a portable format to facilitate a transfer of personal information to another service provider.
f. Right to file a complaint: The User may have the right to lodge a complaint with the relevant authority. The User can find information regarding the relevant authority in the country-specific addendum.

12. Governing Law

This Privacy Policy will be governed and construed under the laws of Sri Lanka without regard to conflict of laws. The User agrees to submit to the exclusive jurisdiction of the Courts located in Colombo, Sri Lanka.
